TERMS OF SERVICE

These Terms of Service (“Terms”) govern your use of TradingPact (“the Service”), operated by TradingPact (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using TradingPact, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Description of Service

TradingPact is a trading discipline enforcement platform. The Service allows you to define trading pacts, lock them for set durations, evaluate trade intents against those pacts, and optionally enforce pacts in real time through broker integrations. TradingPact is a self-discipline tool — it does not provide financial advice, investment recommendations, or trading signals.

3. Account Terms

• You must be at least 18 years of age to use the Service.
• You are responsible for maintaining the security of your account credentials.
• Each account is intended for a single individual. Sharing accounts is not permitted.
• You must provide accurate and complete information during registration and keep it up to date.
• You are responsible for all activity that occurs under your account.

4. Trading Disclaimer

TradingPact does not provide financial advice, and nothing in the Service should be construed as such. All trading pacts are user-defined and user-managed. We are not responsible for:

• Trading losses or gains resulting from decisions you make while using the Service.
• The suitability or effectiveness of any trading pacts you configure.
• Market conditions, broker execution, slippage, or any other factors outside our control.

Trading financial instruments involves substantial risk of loss. You should only trade with capital you can afford to lose.

5. Subscription & Billing

• Paid subscriptions are processed through Stripe. By subscribing, you authorize recurring charges at the applicable rate.
• Subscriptions auto-renew at the end of each billing period unless cancelled.
• You may cancel your subscription at any time from your account settings.
• Cancellation takes effect at the end of the current billing period. No refunds are issued for partial billing periods.
• We reserve the right to change pricing with 30 days’ notice via email.

6. Acceptable Use

You agree not to:

• Use the Service to facilitate market manipulation or any illegal trading activity.
• Abuse, overload, or interfere with our API or infrastructure.
• Attempt to circumvent pact enforcement mechanisms or locked policies.
• Reverse-engineer, decompile, or disassemble any part of the Service.
• Share your API keys or account access with unauthorized parties.
• Use automated systems to scrape or extract data from the Service.

7. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

8. Limitation of Liability

To the maximum extent permitted by applicable law, TradingPact and its officers, directors, employees, and agents shall not be liable for:

• Any trading losses incurred while using or relying on the Service.
• Failures in pact evaluation, enforcement, or broker communication due to technical issues, network outages, or third-party service disruptions.
• Broker disconnections, API downtime, or delays in trade execution.
• Any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied.

9. Termination

We may suspend or terminate your account if you violate these Terms or engage in conduct that we determine, in our sole discretion, to be harmful to the Service or other users. You may cancel your account at any time by contacting us or through your account settings. Upon termination, your right to use the Service ceases immediately. Data retention after termination is governed by our Privacy Policy.

10. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will notify you via email and update the “last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which TradingPact is incorporated, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the competent courts of that jurisdiction.
